PREAMBLE

The present terms and conditions of sale apply automatically and without restriction to all orders placed for the purchase of show tickets on the SEMEC computerized ticketing website, Palais des Festivals et des Congrès de Cannes, La Croisette CS 30051 – 06414 Cannes cedex and at the Palais des Festivals box offices.

They are subject to change without notice. The purchase of ticket(s) implies the buyer’s unreserved acceptance of the present conditions of sale.

All purchasers of tickets or products are invited to carefully read the General Terms and Conditions of Sale, which define the contractual relationship between the purchaser and SEMEC, as well as the conditions applicable to online ticket purchases.

The language of these GTC is French. In the event of translation of all or part of these conditions, only the original French text shall prevail.

Confirmation of the order via the present website entails the conclusion of the definitive contract. This implies the customer’s unreserved acceptance of the entirety of the GCS, which he acknowledges having read before validating his purchase. The customer accepts the provisions concerning safety and additional regulations relating to access to the hall or any other performance venue.

The customer is aware that failure to comply with these regulations will result in refusal of access to the venue without compensation.

The applicable terms and conditions are those in force on the online sales site at the time of ticket purchase. SEMEC reserves the right to adapt or modify these GTC at any time and without notice, to the full extent permitted by law.

PRESENTATION OF THE ONLINE TICKETING SERVICE

www.cannesticket.com is the online ticketing service of SEMEC, whose registered office is La Croisette CS 30051 – 06414 Cannes cedex.

SEMEC’s online ticketing service enables you to purchase tickets for shows, subscriptions and tourist products.

ARTICLE 1- PRICES

Ticket prices include VAT and rental fees.

The applicable prices are those indicated in the programs and at the ticket offices of the Office de tourisme Croisette in Cannes.

All prices are subject to change without notice. However, tickets will be invoiced on the basis of the rates in force at the time of your order validation.

Tickets are validated only after we have confirmed payment.

Tickets are nominative and may not be resold at a higher price (law of June 27, 1919).

The number of seats per transaction may not exceed 6.

1.1- Reduced fares

For reduced fares, presentation of recent proof of entitlement is compulsory when purchasing tickets, as well as at the entrance to the show for access control personnel. No discount is applicable after payment of the order.

1.2- Warning for minors

Children under the age of three are not admitted to any of the shows or screenings at Palais des Festivals. Children under the age of five should not be admitted, except in the case of adapted shows, in which case they should refer to the recommended age on the website or in the program. Parents are advised to bring hearing protection for their children.

The Palais des Festivals reserves the right to refuse access to minors under 16 not accompanied by a legal representative, without refund.

ARTICLE 2 - LOCATION OF SPACES

Depending on the configuration, you may be offered the following seats:

2.1- Numbered seating

For performances with numbered seating, your seat number will be indicated on your ticket when you order.

For performances with numbered seating, the customer may choose the seating area proposed by the online sales site. No subsequent complaints will be accepted.

Each ticket entitles the holder to one seat only. Hall doors are closed from the time indicated on the ticket. Latecomers may only re-enter when the show is interrupted, in which case numbered seats are no longer guaranteed. It is forbidden to photograph, film or record during the performance.

2.2- Free seating

For performances where seating is not numbered, spectators are free to choose their place in the auditorium.

ARTICLE 3- SECURE PAYMENT AND PERSONAL DATA

3.1- Method of payment/secure payment

The SEMEC is only bound by the ticket order on receipt of an e-mail confirming payment of the transaction. Payment is only accepted online.

Tickets purchased on the SEMEC website are paid for exclusively by credit card from the VISA network and cards compatible with the SOGENACTIF secure payment site (Carte bleue / Visa / Eurocard / Mastercard / American Express).

The information provided by the customer when entering his/her bank details is encrypted by our bank to protect all sensitive payment data as effectively as possible. The online payment transaction is handled by the SOGENACTIF system. This transaction is carried out using a secure SSL encrypted system. Under no circumstances and at no time do credit card details pass through the SEMEC server.

Once SOGENACTIF has confirmed that the order has been validated, your card will be debited.

In the event of a problem with payment: check your card’s validity and authorized limit.

Some banks require an additional code for online purchases. Please contact your bank for more information.

3.2- Personal data

Information and data concerning you are necessary for the management of your order and for our commercial relations. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalize the services we offer you and the information we send you.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to information concerning you. This right may be exercised by writing to SEMEC, La Croisette CS 30051 – 06414 Cannes cedex, giving us your surname, first name, address and, if possible, your customer reference. In accordance with current regulations, your letter must be signed and accompanied by a photocopy of an identity document bearing your signature, and must specify the address to which the reply should be sent.

ARTICLE 4 - ORDER CONFIRMATION

Your order for tickets is only definitively confirmed once you have clicked on the “PAY MY ORDER” button, and is only binding on SEMEC once we have received the e-mail confirming that your order has been confirmed. Please check your e-mail address.

ARTICLE 5 - VALIDATION

You declare that you have read and accepted these terms and conditions of sale without reservation before placing your order. Acceptance of the general terms and conditions of sale, by ticking the box “I accept the General Terms and Conditions of Sale”, enables you to validate your order.

ARTICLE 6 - HOW TO OBTAIN TICKETS

The ticket(s) and the online purchase confirmation must be checked by the purchaser at the time they are received. No subsequent claims will be accepted.

All tickets are unique. No duplicates will be issued.

Specific conditions for downloadable tickets:

The downloadable ticket allows you to present your Ebillet received by email on your cell phone without having to print it. Provided that you receive your emails on your cell phone. The virtual ticket has the same value as a classic ticket. It must be presented at the entrance to the theater, in printed or digital form.

You can also print it out on an ordinary printer using Internet access. To be valid when printed, your ticket must be in portrait mode, on a blank A4 sheet of paper, front and back.

A ticket is issued for each seat purchased.

Each ticket has a unique barcode. Ticket validity is checked and recorded at the entrance to the venue concerned, using barcode readers. It is impossible to be admitted several times with the same ticket. Reproduction of tickets is forbidden. Only the first person to present the ticket will be admitted to the event. This person is presumed to be the legitimate ticket holder. It is therefore forbidden to reproduce, duplicate or counterfeit the ticket in any way, or to make it available for such purposes. Keep your ticket in a safe place. Never accept a ticket offered to you by a stranger, as it could be a copy.

The organizer may refuse entry to the event if several prints, reproductions, copies or imitations of a print-at-home ticket are in circulation and access to the event has already been granted to the holder of a print, reproduction, copy or imitation of the corresponding print-at-home ticket. In particular, the organizer is not obliged to check the identity of the person presenting the ticket in order to verify that this is the ticket purchaser, nor to check the authenticity of the ticket insofar as the imitation or copy cannot be unmistakably identified as such at the event entrance control. If the holder of a home ticket is refused entry for this reason, there is no right to reimbursement of the price paid.

SEMEC declines all responsibility: for anomalies that may occur during the ordering, processing or printing of the print-at-home ticket, unless caused intentionally or through negligence, in the event of loss, theft or illicit use of the print-at-home ticket.

ARTICLE 7 - SHOW TIMES AND VENUE

The date, place and time of the show are indicated on the ticket.

Shows start on time, with the auditorium doors generally opening between 15 and 30 minutes before the show.

Latecomers can only be accommodated if the show is interrupted or if the venue is not accessible. To gain access to the auditorium, latecomers must follow the directions of the hosts and hostesses, and numbered seats are no longer guaranteed.

Please note that due to artistic constraints inherent in certain shows, it may not be possible to admit latecomers.

The duration of the show for creations varies and can sometimes be known only a few days before the show.

ARTICLE 8 - CANCELLATION

No cancellation is possible after the customer has paid for the tickets. In the case of shows, case law considers that the relationship established between the venue that announces a show, indicates the price of seats and the time of performance, and the public who buys a ticket, whatever the method of payment (cash, cheque, credit card, money order), is a contractual relationship. Under these conditions, it is only if the entertainment company does not fulfill its obligation that the spectator can request a refund or contest the contract with the venue.

SEMEC reserves the right to make changes to the order, duration and distribution of the show. In addition, SEMEC reserves the right to cancel any performance that cannot take place due to unforeseen circumstances or force majeure, such as (but not limited to) bad weather, strikes, fire, water damage, illness of a performer, etc. In such a case, SEMEC will offer a refund or dispute the contract with the venue. In such a case, SEMEC will offer an alternative performance date or, failing that, a refund of the ticket.

8.1- CANCELLATION OF A SHOW BY THE ORGANIZER WITHOUT POSTPONEMENT

If a show is cancelled, requests for ticket refunds may be sent to SEMEC within a maximum of 3 months after the date on which the show should have taken place.

8.2- POSTPONEMENT OF A SHOW

If a show is postponed to a new performance date (after 24 hours), except in exceptional circumstances, tickets remain valid for the new performance.

If you are unable to attend the new performance date, you may request a refund by sending your request no later than 24 hours before the new date. After this date, no refund will be possible.

If a performance is interrupted after the first half, tickets cannot be taken back, exchanged for another date or refunded.

ARTICLE 9 - RIGHT OF WITHDRAWAL

In accordance with article L 121-20-4 of the French Consumer Code, tickets for shows and related products cannot be withdrawn by the customer.

ARTICLE 11 - APPLICABLE LAW - DISPUTES

Any dispute concerning the online purchase process, whatever its nature, must be made in writing no later than the evening of the performance to the following address:

All other complaints must be made directly to the venue on the evening of the performance.

SEMEC declines all responsibility for any damage whatsoever to belongings, objects or materials brought by spectators. Spectators are responsible for any direct or indirect damage they may cause while at the venue.

Tickets do not entitle the holder to a recording of the show. Any form of recording, including photography, is strictly forbidden. SEMEC reserves the right to take legal action to recover any damages suffered.

ARTICLE 12 - SPECIAL CONDITIONS FOR THE CANNES INTERNATIONAL GAMES FESTIVAL

12.1 Conditions of access

Each visitor must be equipped with a single admission ticket (except for children under one year of age), which can be purchased online at cannesticket.com or directly from the ticket office or Tourist Office. Each ticket entitles the holder to a single, individual entry to the festival.

Day ticket: all exits are final. Visitors leaving the show may re-enter the festival if and only if they purchase a new pass, subject to availability.

Privilege Pass and As d’or Privilege Pass access: ticket holders may enter and leave the festival at their convenience, making sure to present the wristband given to them by the organizers on their first visit. This unique and personal wristband is valid for the entire duration of the event. Loss of the wristband will result in the purchase of a new admission ticket, subject to availability.

Access to the festival is forbidden to minors under 16 unaccompanied by an adult. Access will be refused. Minors may be asked to show proof of identity at the entrance to the show.

Parents and adults accompanying children are responsible for them. The festival advises that children should not be left unsupervised and that the games on offer should be age-appropriate. The festival does not provide childcare or entertainment services, and exhibitors at the stands are not responsible for the safety of any children present.

All members of the public must submit to a bag search and metal detection on site at the entrance to the festival, and as many times as they wish to enter the areas during their visit. Anyone refusing to undergo this search will be refused access to the festival, with no possibility of reimbursement.

Identification must be worn. It is forbidden to bring into the festival any objects which, by their purpose or characteristics, present a risk to the safety of persons or property: firearms, stabbing weapons, reproductions and replicas of realistic weapons (stabbing weapons, firearms, etc.), tear gas bombs. Only foam and latex weapons will be authorized for medieval jousting.

Only water bottles of less than 1 liter and baby equipment will be accepted. All other items must be left at the security checkpoints and will be forfeited.

For safety reasons, strollers are not allowed inside the Festival grounds (outdoor village and Palais des Festivals). Access with a stroller will be refused despite presentation of an access ticket, with no possibility of reimbursement. We invite all visitors with young children to come equipped with a baby carrier.

A compulsory locker is available for bulky backpacks, helmets, suitcases, strollers, scooters, etc.

Anyone behaving inappropriately or in a manner deemed inappropriate by festival organizers and security guards may be immediately excluded from the Festival International des Jeux with no possibility of reimbursement of their admission ticket.

12.2 Access times and locations

The date indicated on each ticket is the date on which the visitor can access the International Games Festival. Anyone presenting a ticket whose date does not correspond to that of the day on which he or she is due to attend will be refused access. Visitors wishing to enter the festival on that day must purchase a new ticket, subject to availability. The old ticket cannot be reimbursed.

The time indicated on each ticket is the opening time of Festival International des Jeux. Due to security constraints inherent to large-scale events, any request for a refund due to failure to gain access at the precise time the festival gates open will be refused.

To gain access to the Festival International des Jeux, visitors must follow the precise signposting set up on site, indicating the access point for each type of ticket.

12.3 Cancellation

No cancellation or rescheduling is possible after the customer has paid for the tickets. In the case of shows, case law considers that the relationship established between the establishment that announces an event, indicates the price of seats and the time of performance, and the public who buys a ticket, whatever the method of payment (cash, cheque, credit card, money order), is a contractual relationship. Under these conditions, it is only if the event company fails to fulfill its obligation that the spectator can request a refund or contest the contract with the organizer.

The SEMEC, organizer of the Festival International des Jeux, reserves the right to make changes to the duration and opening hours of the event. In addition, SEMEC reserves the right to cancel any event that cannot take place due to unforeseen circumstances or force majeure, such as (but not limited to) bad weather, strikes, fire, water damage, etc. In such a case, SEMEC will propose the cancellation of the event. In such a case, SEMEC will propose an alternative date or, failing that, a refund of the ticket.

Cancellation of the Festival International des Jeux by the organizer without postponement :

If the Festival International des Jeux is cancelled, requests for ticket refunds may be sent to SEMEC within a maximum of 3 months after the date on which the event should have taken place.
